Terms of Service

1. Acceptance of Terms

By accessing or using the Indor mobile application and website (collectively, the “Service”), operated by Safe Project Solution (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Indor is a home operating system that provides homeowners, realtors, property administrators, and service providers with tools for managing residential properties. The Service includes but is not limited to:

  • Property facts and profile management
  • AI-powered maintenance scheduling and reminders
  • Document storage and management
  • Connection with vetted service providers
  • Emergency service access
  • Moving setup and checklist tools
  • Home Care Guide and warranty tracking

3. User Accounts

3.1 Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice.

4. User Content and Data

4.1 Your Content

You retain ownership of all content you upload, submit, or store through the Service, including documents, photos, and property information (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing the Service.

4.2 Accuracy of Information

You are responsible for the accuracy of information you provide. Property data auto-filled by Indor is sourced from public records and third-party data providers and may require verification. We do not guarantee the accuracy, completeness, or timeliness of auto-filled property information.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload false, misleading, or fraudulent property information
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated means to access the Service without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, abuse, or harm others

6. Service Providers and Third-Party Services

6.1 Vetted Professionals

Indor connects users with third-party service providers. While we vet service providers, we do not guarantee the quality, safety, or legality of their services. Any agreements or transactions between you and a service provider are solely between you and that provider.

6.2 Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is at your own risk.

7. Payments and Subscriptions

Certain features of the Service may require payment. All payments are processed through secure third-party payment processors. Prices, fees, and payment terms will be disclosed before any purchase. Refund policies are subject to the terms disclosed at the time of purchase.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, code, content, trademarks, and logos (including “Indor,” “The Home Operating System,” and “House Facts”), are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) property data or information will be accurate or complete; (c) results from the Service will meet your requirements; or (d) any defects will be corrected.

INDOR IS NOT A LICENSED HOME INSPECTOR, REAL ESTATE AGENT, CONTRACTOR, OR LEGAL ADVISOR. Information provided through the Service is for general informational purposes only and should not be relied upon as professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INDOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Indor and its affiliates from any claims, liabilities, damages, losses, or expenses arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your User Content.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. General Provisions

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in effect.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Indor regarding the Service.
  • Assignment: You may not assign your rights under these Terms without our written consent.
